Terms of Service
Last updated: 2026-05-20
These Terms of Service (“Terms”) govern your access to and use of the website pixmoly.com and the products, downloads, APIs and credits-based services offered there (collectively, the “Service”). The Service is operated by Pixmoly, a Delaware company (“Pixmoly”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
- You must be at least 16 years old to create an account.
- Accounts are created via Google sign-in. You are responsible for keeping your Google account secure; any action taken through your signed-in session is attributed to you.
- You may connect desktop clients to your account via the device-code flow. Each device receives an API token you can revoke at any time from your dashboard.
2. Products we sell
We currently sell two kinds of items:
- Downloadable software (e.g. Pixmoly Clipboard Pro) — a one-time purchase delivered as a downloadable file with a license key.
- Credits packs — prepaid credits that can be consumed inside paid features (e.g. AI-powered services). Credits have no cash value, are non-transferable, and do not expire.
3. License grant (software)
Subject to your payment and ongoing compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the purchased software on devices you own or control, for personal or internal business use. You may not:
- resell, sublicense, rent, lease, or distribute the software;
- reverse-engineer, decompile, or modify it, except to the extent allowed by mandatory law;
- remove copyright or other proprietary notices;
- use it to build a substantially similar competing product.
License keys are tied to your account. We may limit the number of concurrent activations.
4. Credits & paid APIs
- Credits are debited each time you invoke a paid feature; the per-call cost is shown before invocation when possible.
- We may change pricing of future purchases, but already-purchased credits keep their original purchasing power for the features available at the time of purchase.
- We may temporarily suspend paid features if our upstream providers (e.g. AI model providers) become unavailable. Where possible we will refund credits consumed by failed calls.
5. Payment
Payments are processed by PayPal. We do not see or store your full payment instrument; we receive a transaction reference and metadata sufficient to fulfill your order and comply with tax / accounting obligations. Prices are in USD unless stated otherwise and exclude any local taxes that may apply to you.
6. Refunds
See our Refund Policy.
7. Acceptable use
You agree not to:
- use the Service for anything illegal or that infringes others’ rights;
- attempt to access accounts, data, or systems that are not yours;
- probe, scan, or stress-test the Service or its APIs in a way that degrades service for others;
- submit content to AI features that you don’t have the right to submit, or that violates the upstream provider’s acceptable use;
- resell access to your account or API tokens.
8. Intellectual property
All rights in the Service, the software, the website content, and the trademarks (including “Pixmoly”) are owned by us or our licensors. You retain ownership of content you submit to the Service; you grant us a non-exclusive license to process it solely to provide the Service.
9. Third-party services
The Service relies on third parties (Google for sign-in, PayPal for payments, Resend for email, Cloudflare for delivery, and AI/model providers for paid features). Their terms apply to their portions of the Service.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service in any 12-month period will not exceed the greater of (a) the amount you paid us in that period or (b) USD 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. fraud, gross negligence, or statutory consumer rights).
12. Indemnity
You agree to indemnify and hold us harmless from any claim arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time by emailing [email protected]. We may suspend or terminate your account if you materially breach these Terms or create legal/operational risk for us. After termination, license keys for previously-purchased software remain valid for personal use.
14. Changes
We may update these Terms. If changes are material, we will notify you by email or a notice on the site at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
15. Governing law & jurisdiction; target market
The Service is offered to and intended for users in the United States. We do not target, advertise to, or solicit business from data subjects in the European Economic Area, the United Kingdom, or any other jurisdiction outside the United States. If you choose to access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with your local laws.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section overrides mandatory consumer-protection rights you may have in your state of residence.
